And In the matter of : Shibnath Shaw ……Petitioner. Mr. Pritam Roy Mr. S. Kr. Seal ……for the Petitioner. Mr. Gouranga Kr. Das, APP Ms. Anushka Ghosh ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 9 and a half months and he has been falsely implicated in the instant case. According to the petitioner even if the materials collected by the Investigating Agency is accepted to be true, no case has been made out so far as the present petitioner is concerned. Learned advocate for the State submits that there are overwhelming materials so far as the present petitioner is concerned including statement of eye witnesses. Having considered the fact that till date charges have not been framed and the case has only been committed to the 2 Court of Sessions, at this stage, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner in CRM (M) 420 of 2026 is rejected. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
