Mr. R. Borah, the learned counsel appearing on behalf of the Petitioner submits that fixing the closing date of receipt of
Page No.# 3/3 the application form i.e. 14.10.2024 as the last date for obtaining the certificate in terms with Clause 6.5 is arbitrary and in violation of Articles 14 and 16 of the Constitution. He further submits that a very perusal of the Notice dated 05.09.2024 would reveal that the age as well as the educational qualification is counted as on 01.01.2025 but surprisingly by Clause 6.5 mandates the certificate in Annexure-VII to be not later than the closing date for receipt of the application form has been mentioned as 14.10.2024. He therefore submits that the Petitioner would be well advised to withdraw the instant writ petition with a liberty to re-file by challenging Clause 6.5 along with the rejection of the Petitioner’s candidature. 2. Taking into account the above, the instant writ petition stands closed on withdrawal. 3. However, the withdrawal of the writ petition shall not prejudice or preclude the Petitioner to file a fresh writ petition challenging Clause 6.5 of the Notice dated 05.09.2024 as well as the impugned rejection of the Petitioner’s candidature.
