The above writ petition was filed to declare the action of the respondents in attempting to demolish the petitioner’s house bearing assessment Nos.108 and 109 in survey Nos.87 and 91, situated at Nuzellapalli Village, J. Panguluru Mandal, Bapatla District, without passing orders on the explanation dated 16.04.2026, as illegal and arbitrary. 3. The learned counsel for the petitioner would submit that the Panchayat Secretary of respondent No.3, without conducting any enquiry, is attempting to demolish houses bearing assessment No.108 and 109 constructed by the petitioner in survey Nos.87 and 91, situated at Nuzellapalli Village, J. Panguluru Mandal, Bapatla District. 4. Learned standing counsel for respondent No.3 would submit that the Panchayat Secretary of respondent No.3 will conduct an enquiry in pursuance of Ex.P1, show cause notice, dated 06.04.2026 and Ex.P3, explanation, dated 16.04.2026 and pass a reasoned order. 5. Given the facts and circumstances of the case, inviting a counter and keeping this writ petition pending may not serve any purpose. 6. Hence, this writ petition is disposed of at the admission stage with the consent of learned counsel on either side with the following directions: i) The Panchayat Secretary of respondent No.3 shall conduct an enquiry pursuant to the show cause notice, Ex.P1 and explanation, Ex.P3. ii) The Panchayat Secretary shall fix a date and provide an opportunity of hearing to the petitioner. iii) Thereafter, the authority shall pass a reasoned order and communicate the same to the petitioner. iv) The Panchayat Secretary of respondent No.3 shall complete the entire exercise within two months from the receipt of a copy of this order. Till an order is passed, the Panchayat Secretary of respondent No.3 shall not interfere with the houses bearing assessment Nos.108 and 109 in survey Nos.87 and 91, situated at Nuzellapalli Village, J. Panguluru Mandal, Bapatla District. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
