The petitioners are apprehending their arrest in connection with Chauparan PS Case No.118 of 2026, for offence registered under section 303(2), 317(5) and 3(5) of the BNS, 2023, Section 4 and 21 of Mines and Minerals (Development and Regulation) Act, 1957, Rules 9 and 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in court of learned Judicial Magistrate, First Class, Hazaribagh.

Learned counsel for petitioners submits that the petitioner no.1 is driver and the petitioner no.2 is the owner of Hywa Truck and the allegations are made of loading stone chips on the said vehicle. He next submits that the alleged allegation is of 21.04.2026 whereas the FIR and the seizure list have been prepared on

01.05.2026. He next submits that in the seizure list, there is no independent witness. On these grounds he submits that anticipatory bail may kindly be granted.
4. Learned State counsel opposes prayer and submits that allegations are there of illegally loading the said stone chips.

Considering that the petitioner no.1 is driver and the petitioner no.2 is the owner of the said vehicle and the allegations are made of loading stone chips on the said vehicle on 21.04.2026 whereas the FIR and seizure list have been prepared on 01.05.2026 and even in the seizure list, there is no independent witness, I am inclined to grant anticipatory bail to petitioners.
6. Accordingly, both the petitioners, above named, are hereby
directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, First Class, Hazaribagh, in connection with Chauparan PS Case No.118 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
