Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner was the employee of an institution engaged in imparting education and training relating to the stock market. He had no idea as to whether the organization had raised funds. In any event, no part of the alleged funds came to the petitioner’s bank account. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He submits that huge sums of money were taken from different victims for investment, but were defalcated. He relies on the statements of the victims, including that of the informant in the present FIR, as well as the statements of other similar victims recorded before the learned Magistrate stating that the present petitioner and another had specifically induced the victims to part with huge sums of money and deposit them into a bank account for the purpose of investment. However, all such sums were defalcated. 2 Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
