The petitioner is challenging the appellate order passed by the Deputy Commissioner in a mutation proceeding. 3. From the record it is apparent that initially the mutation was done in favour of the petitioner but at the appellate stage at the instance of the private respondents considering all the aspects, the Deputy Commissioner has reversed the order and directed to mutate the land in the joint name of the petitioner and the private respondents. The aforesaid order has been challenged. 4. After going through the records and the arguments, I find that the matter relates to disputed question of fact in relation to 2026:JHHC:25133 2 right, title, interest and partition of the land in question. This complicated question cannot be decided in an application under Article 226 of the Constitution. The petitioner should approach the appropriate Civil Court for the reliefs as it is necessary to lead evidence to come at a conclusive finding on title and possession. 5. If any suit is filed, the same should be decided on its own merits, without being prejudiced by any order passed by any Revenue Authority. On conclusion of the suit, it is expected that the Revenue Authority will be abide by the judgment and decree and make correction in the revenue records, if necessary. 6. If any application under Order XXXIX Rule 1 & 2 of the Code of Civil Procedure is filed along with plaint, it is expected that the Trial Court will take up the said application and dispose of the same as early as possible. 7.
