1. Learned Advocate for the petitioner submits that the petitioner is in custody for three years five months and till date four witnesses have been examined. An application under Section 311 of the Cr.P.C has been filed by the prosecution after the evidence of the four witnesses were over. There is no possibility of the trial concluding in near future as such the petitioner has prayed for bail. 2. Learned Advocate for the State opposes the prayer for bail and relies upon the post mortem report including the statement of the witnesses under Section 164 of the Cr.P.C.

3. Having considered the period for which the petitioner is in custody and without entering into the merits of the case I am inclined to release the petitioner on bail

Accordingly, petitioner, namely, Saddam Molla shall furnish a bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Howrah. 5. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the district of Howrah without prior permission of the learned Trial Court. 6. The learned Trial Court would if required impose additional condition for securing the presence of the petitioner in the day to day proceedings. 7. With the aforesaid observations C.R.M (M) 699 of 2026 is allowed. 8. Report submitted by the State be kept with the record. 9. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court. 10.
