ORDER : The Court made the following order :- The petitioners/A1 to A15, who apprehend arrest at the hands of the respondent for the offences punishable under Sections 191(2), 191(3), 296(b), 115(2), 118(1), 351(2) and 324(2) of BNS, 2023, in Crime No.55 of 2026 on the file of the respondent police, seek anticipatory bail. 2. The case of the prosecution is that on 25.03.2026, due to dispute regarding the encroachment of land, the petitioners and other accused persons trespassed into the defacto complainant's housed abused him in filthy language and also assaulted him and his family members with hands and caused injuries. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they were falsely implicated in this case and they are no way connected in the above said incident. He would further submit that it is a case in counter case. a counter complaint has been registered against the defacto complainant in Crime No.54 of 2026. Hence, he prays to grant anticipatory bail to the petitioners. 4. The learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that the investigation is pending and the offences are grave in nature and the injured persons have been discharged from the hospital and the petitioners have no previous cases. Heard both sides and perused the materials available on record. 6. Considering the rival submissions on either side and the nature of offences charged against the petitioners and there was a dispute between the parties regarding the encroachment of the land and the counter complaint has been registered against the defacto complainant in Crime No.54 of 2026 and the petitioners have no previous cases and also considering the fact that the injured persons have been discharged from the hospital, I am inclined to grant anticipatory bail to the petitioners, subject to the following conditions: [a] Accordingly, the petitioners are ordered to be released on anticipatory bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a 4/8 https://www.mhc.tn.gov.in/judis CRL OP(MD). [c] the petitioners shall not commit any offences of similar nature. [d] the petitioners shall not abscond either during investigation or trial. [e] the petitioners shall not tamper with evidence or witness either during investigation or trial.
