INDRAJEET SAHU Digitally signed by INDRAJEET SAHU Date: 2026.03.19 10:19:35 +0530 2 10.2 That, this Hon'ble Court may kindly quash the personal bond dated 24/09/2025 that has been granted by SHO/P.S Farasgaon, District-Kondagaon. 10.3 That, this Hon'ble Court may kindly direct the SHO/P.S Farasgaon, District-Kondagaon to arrest accused Vandana Mehra as per ANNEXURE-P/3. 10.4 That, this Hon'ble Court may Direct the respondent police authorities to complete the investigation and file charge-sheet/challan in FIR No. 137/2022 within a fixed time frame as may be stipulated by this Hon'ble Court. 10.5 That, this Hon'ble Court may kindly be pleased to take strict legal action against SHO Farasgaon, District-Kondagaon. 10.6 That, this Hon'ble Court may kindly be pleased to grant any other relief or pass such other and further orders as may be deemed fit and proper in the facts and circumstances of the present case in the interest of justice.” 2 Facts of the case are that, the petitioner being a Social Worker made a written complaint against the private respondent on 24.08.2022 alleging that she had fraudulently obtained multiple ration cards by making false declarations regarding caste, residence and family members and are illegally availing Public Distribution System benefits from the State of Chhattisgarh as also from the State of Uttar Pradesh. That, after inquiry the allegations were found to be correct and an FIR bearing No. 0137/2022 was registered on 14/12/2022 at Police Station Farasgaon for offence punishable under Section 9(2) of the Essential Commodities Act, 1955 and Sections 420 and 468 of IPC. Despite registration of FIR in the year 2022, the investigation is not concluded and no charge-sheet has been filed and resultantly the accused is not arrested till now. The petitioner approached before the Superintendent of Police on 05/12/2023 and sought information under the Right to 3 Information Act, 2005 on 14/11/2025. In response, the police disclosed that notices were issued to the accused under the provisions of the Bharatiya Nagarik Suraksha Sanhita (BNSS) and that on 24/09/2025 panchnama was prepared and documents were collected. The grievance of petitioner is that crime is of the year 2022, however till date despite registration of FIR in the year 2022 itself, investigation is not concluded and charge sheet has not been filed due to apathy of concerned department and delaying the trial and as such the department may be directed to conduct fair and effective investigation. 3 Having heard the counsel for the parties and having perused the material annexed with the petition, we are not inclined to entertain the writ petition at this stage as according to State counsel, investigation is almost complete and department is going to file a closure report shortly. However, if the petitioner is aggrieved by the closure report, to be filed, he may take recourse of law available to him under the relevant provisions. 4 The writ petition is accordingly dismissed.
