JUSTICE S VISHWAJITH SHETTY ORAL ORDER This petition is filed under Section 483(1)(b) of the Bharatiya Nagarik Suraksha Sanhita, 2023 by accused No.1 with a prayer to relax/modify condition No.(v) imposed by this Court in Crl.P.No.11663/2025, which was disposed of on 03.09.2025. 2. Heard learned counsel for the petitioner and learned Additional State Public Prosecutor on behalf of the respondent - State. 3. The petitioner had approached this Court in Crl.P.No.11663/2025 seeking regular bail in Crime No.49/2025 registered by the Dakshina Kannada Women Police Station, Puttur Sub-Division, Dakshina Kannada - 3 - HC-KAR NC: 2026:KHC:31686 CRL.P No. 8556 of 2026 District for the offence punishable under Sections 64(1) and 69 of Bharatiya Nyaya Sanhita (BNS), 2023. The said petition was allowed by the Co-ordinate Bench of this Court vide order dated 03.09.2025 subject to certain conditions. 4. Condition No.(v) imposed in the order passed in Crl.P.No.11663/2025 reads as follows; "(v) The petitioner shall not leave the jurisdiction of the trial Court without prior permission of the Court till the case registered against him is disposed of." 5. Seeking relaxation/modification of the aforesaid condition, the petitioner is before this Court. 6. Learned Senior Counsel appearing on behalf of the petitioner submits that the further proceedings in Crime No.49/2025 has been now stayed by the Co-ordinate Bench of this Court in W.P.No.11843/2026 and there is an observation in the said order that the parties shall appear before the Karnataka Mediation - 4 - HC-KAR NC: 2026:KHC:31686 CRL.P No. 8556 of 2026 Centre, Bengaluru for exploring the possibilities of settlement. He submits that in view of the aforesaid, condition No.(v) may be relaxed. 7. The said submission is not seriously opposed by the learned Additional State Public Prosecutor. 8. Under the circumstances, I am of the opinion that the prayer made by the petitioner in this petition needs to be granted. Accordingly, the following: ORDER (i) The Criminal Petition is allowed. (ii) The condition No.(v) imposed by this Court in Crl.P.No.11663/2025, disposed off on 03.09.2025, stands relaxed. (iii) All other conditions imposed in the said order remain unaltered.
