Learned Advocate appearing for the petitioners submits that other than the statement of a co-accused, no incriminating materials are available against the present petitioners. Learned Advocate appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on a report which is taken on record and submits that there are phone call records available ragarding calls made between the petitioners and the principal accused at the relevant time. Considering the above, the other incriminating materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I am not inclined to grant anticipatory bail to the petitioners. The application for anticipatory bail is, thus, dismissed. ( Jay Sengupta, J. )
