Kausik (Rejected) CRM (NDPS) 833 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliganj Police Station Case No. 515 of 2025 dated 14.06.2025 under Section 21(c)/29 of the NDPS Act, 1985. And In the matter of : Rehena Bibi & Anr. ……Petitioners. Mr. Satadru Lahiri Mr. Priyankar Ganguly Ms. Shalini Bairagi Ms. Pipasa Chakraborty ……for the Petitioners. Mr. Gouranga Kumar Das, APP Mr. Amal Kumar Datta ……for the State. Learned advocate appearing for the petitioner submits that from the custody of the petitioners’ along with others, 980 Gms. of Heroin were recovered. Petitioners are in custody since 14.06.2025. Charge sheet has already been submitted before the jurisdictional Court. Learned advocate for the State opposes the prayer for bail. In view of the quantum of contraband seized, petitioner emphasizes on the chemical examiner’s report wherein there has been no quantification and the contrabands which is 2 reflected in the chemical examiner’s report is Codeine, Morphine and 6-Monoacetylmorphine. Having considered the quantum the application for bail of the petitioner is rejected at this stage. Petitioner would renew his prayer for bail after the evidence of the seizure list witnesses is over. It has been informed that the next date has been fixed on 24th June, 2026 and 25th June, 2026. If the seizure list witnesses are not examined on the said date, learned Trial Court would ensure that within a month from the said date efforts are taken for completing the seizure list witnesses. At this stage, CRM (NDPS) 833 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
