By way of this petition, the petitioners have prayed for following reliefs:- “10.1 The Hon'ble Court may kindly be pleased to call for the entire records of the order dated 28.04.2026 passed by the office of respondent no. 2 in case no. 114 B/121 year 2025-26 (ANNEXURE P-11) for kind perusal of this Hon'ble Court. 10.2 The Hon'ble Court may kindly be pleased to set- aside/quash the Order dated 28.04.2026 passed by the office of respondent no. 2 in case no. 114 B/121 year 2025-26 (ANNEXURE P-11). 10.3 The Hon'ble Court may kindly be pleased to issue writ/order/ appropriate direction towards the respondent no. 2 to comply the notification dated 29.07.1997 issued by the earth-while state of Madhya Pradesh and memo dated 17.09.2010 passed by the Collector Raipur (same authority). 10.4 That, the Hon'ble Court may kindly be pleased to issue writ/order/ appropriate direction towards the respondent no. 2 to 5 to do not create any hindrance 7 upon the cultivating of crops done by petitioners in their occupied land bearing khasra no. 1018, 1136, 1137, 1150, and 352 situated at village Sonisilli P.H. No. 42 new 17 RNM Nawapara Tahsil Gobra Nawapara District - Raipur. 10.5 That, the Hon'ble Court may kindly be pleased to grant any other relief, as if may deem fit and appropriate.” 2. Learned counsel for the petitioners submits that, pursuant to the order passed by this Court in the earlier round of litigation, revenue proceedings were initiated before the competent Collector with regard to the allotment of the subject land by way of lease/patta, which had originally been granted in favour of the concerned Society. It is submitted that the petitioners, being members of the said Society, came into possession of the land after the dissolution of the Society and have continued to remain in possession thereof. Learned counsel further submits that the Tahsildar subsequently passed an order adversely affecting the rights of the petitioners, whereupon the petitioners challenged the said order before the competent forum. During the course of those proceedings, it was held that the Tahsildar lacked the jurisdiction, power and authority to pass such an order. Consequently, the petitioners were relegated to approach the competent Collector, and the Collector was directed to consider and decide the matter in accordance with law. It is further submitted that, in compliance 8 with the aforesaid directions, the Collector has now passed an order dated 28.04.2026 directing the revenue authorities to mutate the name of the State Government in respect of Khasra Nos. 443 and 528 (new Khasra Nos. 1018, 1136, 1137, 1150 and 352), situated at Village Sonisili, in the revenue records. 3. Per contra, learned counsel appearing for the State has raised a preliminary objection regarding the maintainability of the present writ petition by contending that the petitioners have an efficacious and alternative statutory remedy available under the provisions of the Chhattisgarh Land Revenue Code. It is submitted that, instead of invoking the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India, the petitioners ought to have availed the revisional remedy available under the statute, which they have failed to do. 4. Learned counsel appearing for respondent No. 5 has also opposed the writ petition and submits that the petitioners have been unnecessarily delaying and obstructing the proceedings. It is contended that the present writ petition has been filed without exhausting the alternative statutory remedy available to the petitioners and, therefore, the same is not maintainable. 5. Having heard learned counsel for the parties and perused the material available on record. 6. Having regard to the aforesaid facts and circumstances of the case, this Court is of the considered opinion that the petitioners 9 have an efficacious alternative remedy available under the statute. Accordingly, the petitioners are granted liberty to approach the competent revisional authority, namely, the Commissioner, Raipur Division, by filing an appropriate revision within a period of fifteen (15) days from the date of receipt of a certified copy of this order. Till such time, the parties shall maintain status quo with regard to the entries existing in the revenue records as on the date of passing of this order. 7. It is made clear that this Court has not expressed any opinion on the merits of the case. 8. It is further observed that the respondent authorities shall be at liberty to proceed in accordance with law. However, it is made clear that if the petitioners fail to approach the Commissioner, Raipur Division, within the stipulated period of fifteen (15) days, the interim protection granted by this order shall lose its efficacy. 9. It is further directed that, in the event the petitioners file an application seeking interim relief under Section 52 of the Chhattisgarh Land Revenue Code before the competent revisional authority, the same shall be considered and decided expeditiously, strictly in accordance with law, keeping in view the earlier orders passed by this Court as well as the facts and circumstances of the present case. 10. The Registry is directed to return the relevant copies of the petition to the petitioners after retaining photocopy of the same. 10 11. With the aforesaid direction, the writ petition is disposed of.
