THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 and 2 are before this Court calling in question registration of a crime in Crime No.128/2026, pending before the Additional Civil Judge and JMFC, Devanahalli, for the offences under Sections 316(2), 318(4) r/w. 3(5) of the BNS, 2023. - 3 - HC-KAR NC: 2026:KHC:31641 CRL.P No. 8508 of 2026 2. Learned counsel for the petitioners and respondent No.2 in unison would submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed a joint memo and a joint affidavit before this Court to that effect. 3. The joint memo reads as follows: “1. XXXX 2. XXXX 3. XXXX 4. With the Intervention of elders, well wishers and persons known to both parties, the disputes between the Petitioners and Respondent No.2 have now been amicably resolved. Respondent No.2 states that she has no subsisting grievance against the Petitioners, that any monetary issues stand settled and that she does not wish to proceed with the criminal case in Crime No. 128/2026 against the Petitioners any further. 5. Respondent No.2 expressly submits that the dispute between the parties is purely alleged commercial and contractual in nature, arising out of a home based packing arrangement, and that continuation of criminal proceedings would serve no useful purpose and would amount to abuse of the process of law. Respondent No.2 has no objection if the said FIR and all further proceedings arising therefrom are quashed by this Hon'ble Court. 6. The Petitioners and Respondent No.2 jointly state that this compromise is voluntary, without any force, coercion or undue influence, and is in the interest of maintaining cordial unnecessary litigation. - 4 - HC-KAR NC: 2026:KHC:31641 CRL.P No. 8508 of 2026 In view of the above settlement, the Petitioners and Respondent No.2 jointly pray that this Hon'ble Court may be pleased to Quash the FIR in Crime No. 128/2026 registered by Chikkajala Police Station, Bengaluru, for the offences punishable under Sections 316(2) and 318(4) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, and all further as the proceedings arising therefrom, insofar Petitioners are concerned to Pass such other order or orders as this Hon'ble Court may deem fit in the facts and circumstances of the case, in the interest of justice and equity.” In the light of the afore-quoted joint memo of the parties, I deem it appropriate to terminate the proceedings against the petitioners, as the dispute and the allegations are between the individuals and not against the State. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. (b) The impugned crime in Crime No.128/2026, pending before the Additional Civil Judge and JMFC, Devanahalli, qua the petitioners, stands quashed.
