Heard Mr. Anoop Majumdar, Sr. Advocate along with Mr. Priyanshu Gupta, learned counsel for the petitioners. Also heard Mr. Priyank Rathi, learned Govt. Advocate, appearing for the Respondent- State. 2. The present petition has been filed by the petitioners with the following prayer:- "10.1 To call for the entire record of the Criminal Case No. 3793/2026 pending before learned Judicial Magistrate First Class (JMFC), Korba District Korba (C.G.). 10.2 To Quash the Charge Sheet no. 227/2026 dated 29.04.2026 filed against Petitioners in pursuance to Crime No. 306/2205 filed before learned Judicial Magistrate First Class (JMFC), Korba District Korba (C.G.) filed & marked as Annexure A-1. 10.3 To set aside Order dated 30.04.2026 passed by leanred Judicial Magistrate First Class (JMFC), Korba District Korba (C.G.) in Criminal Case No. 3793/2026 to the extent of taking cognizance against the petitioners in Crime No. 306/2025, filed & marked as Annexure A-5. 10.4 To Quash the FIR bearing Crime No. 306/2025 got registered at Police Outpost Manikpur, Kotwali Police, Korba District Korba (C.G.) and consequent criminal proceeding of 3 Criminal Case no. 3793/2026 pending before learned Judicial Magistrate First Class (JMFC), Korba District Korba (C.G.) against the instant Petitioners, filed & marked as Annexure A-1 (Page No. 15). 10.5 Any other suitable relief deeming fit to be awarded to Petitioners may also be awarded for the ends of justice." 3. At the time of hearing, this Court observed that the prayer made in the present petition is defective, as the offences in respect of which the charge- sheet has been filed have not been mentioned in the relief clause. 4. In such a situation, learned counsel for the petitioners seeks permission to withdraw the present petition with liberty to file a duly constituted petition. 5. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty subject to depositing a sum of Rs. 5,000/- as cost by the petitioners in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Government Observation Home, District Korba (C.G.).
