Order No. 03
Dated 20th August, 2026
Heard the learned counsel for the respective sides.
This application is directed against the order dated 25.06.2025 passed by the learned Additional Sessions Judge-I, Hazaribag in S.T. Case No. 487 of 2024 arising out of Lohsinghna P.S. Case No. 112 of 2024, whereby and whereunder, the application preferred by the petitioner for discharge has been rejected.
Submission has been advanced by Mr. Verma, learned counsel for the petitioner that the informant was a consenting party to sexual overtures of the petitioner and she being a major, no offence is made out against the petitioner.
Learned A.P.P. has opposed the prayer made in this application.
The allegation reveals that on the pretext of marriage for the last 4-5 years, the petitioner had established physical relationship with the informant and when the informant had insisted for the marriage, the petitioner had refused and he was in fact trying to marry somebody else.
The learned trial court has considered the fact that there is a prima facie case made out against the petitioner. At the time of hearing of discharge application, this Court cannot sift through the evidence to come to a conclusion. In fact, the evidence of the witnesses does support the allegation levelled against
the petitioner. It would be premature at this stage to interfere with the criminal prosecution against the petitioner and since the learned trial court has considered all the aspects of the matter, while rejecting the application for discharge preferred by the petitioner, I am not inclined to entertain this application which consequently dismissed as well.
