The petitioner has filed this petition against the order dated 06.06.2025 passed by respondent No. 3 by which the respondent No.3 has suspended the allotment of Fair Price Shop of the petitioner without giving proper opportunity of hearing to him. 2. Learned counsel for the petitioner would submit that the respondent No. 3 without considering the fact has suspended the allotment of Fair BHUMIKA ANGARE Digitally signed by BHUMIKA ANGARE Date: 2026.01.21 16:36:28 +0530 2 Price Shop of the petitioner which is illegal and mala-fide and would pray for quashing of the order. 3. On the other hand learned counsel for the State would submit that it is an appealable order as per Order 18 of the Chhattisgarh Public Distribution System (Control) Order, 2016, therefore, the instant writ petition at this juncture is not maintainable. 4. I have heard learned counsel for the parties and perused the record with utmost circumspection. 5. Since the petitioner has an alternate and efficacious remedy of filing an appeal under Order 18 of the Chhattisgarh Public Distribution System (Control) Order, 2016 before the Appellate authority, therefore, this petition is not maintainable at this juncture. 6. Accordingly, the instant writ petition is disposed of. 7. It is made clear that if the petitioner prefers an appeal within 30 days from the date of receipt of copy of this order, the appellate authority will not take plea of limitation as this Court has condoned the delay in preferring the appeal and will decide the case on its own merit within two months from the date of receipt of copy of the appeal. 8.
