MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 01.07.2026
01.
1. Heard learned counsel for the respective parties.
2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Adava P.S. Case No.46 of 2026 corresponding to G.R. Case No.79 of 2026 pending in the file of learned court of J.M.F.C., Mohana, District-Gajapati on the grounds stated therein.
3. The petitioner had earlier approached this Court in the ABLAPL disposed of on 4th May, 2026, a copy of which is at Flag-B. Gone through the FIR as at Annexure-1. Upon rejection of the bail plea of the petitioner vide Annexure-3, he has approached once again claiming that the recovery and seizure of SBML guns have been made by the police alleging it to be possessed by him. The details of the circumstances leading to the recovery of the firearms are described in the FIR i.e. Annexure-1. It is claimed that the petitioner does not have any similar antecedent and a tribal man. Recorded the objection of the State. It is alleged that the petitioner managed to flee p. 2 seeing the police party dumping the firearms that led to its seizure. Considering the above facts and submissions of learned counsel for the respective parties and recording the claim that the petitioner has no other similar antecedent and he was identified subsequently during the enquiry by the local PS, this Court, though not in favour of entertaining his bail plea, is inclined to direct him to surrender before the learned court below for being released with stringent conditions.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of. It is directed that in the event, the petitioner surrenders before the learned J.M.F.C., Mohana, District-Gajapati in connection with Adava P.S. Case No.46 of 2026 corresponding to G.R. Case No.79 of 2026 within a fortnight from today, he shall be released on bail upon furnishing bail bond of Rs.30,000/-(rupees thirty thousand only) with one solvent surety for the like amount and on such other terms and conditions as deemed just and proper in the
facts and circumstances of the case besides the following, such as, he shall furnish an undertaking at the local PS not to involve himself in similar nefarious activities while on bail. It is further
directed that the above order shall not be given effect to if the petitioner has other similar antecedents.
6. Issue urgent certified copy as per rules.
