Usha Devi, father/husband name- not known, Assistant Sub-Inspector, Mahila/A.H.T.U. P.S. Khunti, P.O. Khunti, P.S.- Khunti, District-Khunti …. …. Opp. Parties --- CORAM: Hon’ble Mr. Justice Rongon Mukhopadhyay Hon’ble Mr. Justice Arun Kumar Rai For the Petitioner: Mr. Sunil Kumar Ganjhu, Advocate For the Resp.-State: A.P.P. --- 02/ 18.08.2026 Heard Mr. Sunil Kumar Ganjhu, learned Counsel for the petitioner and learned A.P.P. 2. In this application, the petitioner has prayed for quashing of the entire criminal proceedings in connection with Khunti (A.H.T.U.) P.S. Case No. 06/2022, registered for the offences under Section 363/370(4)/371/374 IPC, Section 16/18 of the Bonded Labour System Abolition Act and under Section 3(1) of the Child Labour Prohibition Act. 3. It has been alleged that some minor girls were taken to New Delhi to the Placement Agencies from where they were engaged to do domestic work in several households. 2026:JHHC:24820-DB 4. Submission has been advanced by the learned Counsel for the petitioner that there is no allegation against the petitioner of indulging in human trafficking. 5. It has been submitted that the petitioner merely runs a Placement Agency whose primary object is to provide domestic help to various households. 6. Learned A.P.P. has opposed the prayer made in this application. 7. It appears that the Placement Agency of the petitioner, namely, Teresa Placement Service was instrumental in securing jobs for the minor girls who were taken from the State of Jharkhand and one of the victims, namely, Naipi Tuti has specifically taken the name of the petitioner who is the owner of Teresa Placement Service from where the victim was kept as a domestic help in the house of Sanjay Sharma and she also used to work in the house of the sister of Sanjay Sharma. She has alleged that she worked as a domestic help for ten years, but she was not paid for the work she had done. The statement of Naipi Tuti categorically reveals about the involvement of the petitioner in being a cog in the wheel of human trafficking as it was his Agency which was 2026:JHHC:24820-DB instrumental in recruiting minor girls from Jharkhand and engaging them as domestic help in various households. There is also specific allegation that despite working for 10 years, the said Niapi Tuti did not receive any monetary benefit. It also appears that on completion of investigation, charge-sheet has been submitted against the petitioner. There being a specific allegation against the petitioner of being involved in human trafficking, we are not inclined to entertain this application which, accordingly, stands dismissed. 8. This Cr.M.P. is dismissed. (Rongon Mukhopadhyay, J) (Arun Kumar Rai, J) 18th of August, 2026 P.K.S./Suman Uploaded
