The petitioners are apprehending their arrest in connection with Devipur P.S. Case No. 69 of 2026, registered for the offence under Sections 191(2), 126(2), 115(2), 109(1) and 352 of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Deoghar. 3. After some argument, learned counsel appearing on behalf of the petitioners seeks permission to withdraw this application with respect to petitioner nos.1 and 2 with liberty to move before the learned court to file appropriate petition. 4. Learned counsel appearing for the State and the informant have got no objection. 5. Accordingly, this application is dismissed as withdrawn with the aforesaid liberty with respect to petitioner no.1- Hafij Ansari and petitioner no.2- Nishad @ Nishar Ansari. 6. Now this anticipatory bail application survives for petitioner no.3- Samsher @ Shamshed Ansari. 7. Learned counsel appearing for the petitioners submits that so far petitioner no.3- Samsher @ Shamshed Ansari is concerned, there are general and omnibus allegation and entire family members have been made accused. He submits that there are case and counter case and both the 2026:JHHC:25137 sides are family members. On these grounds, he submits that anticipatory bail may kindly be granted. 8. Learned counsel appearing for the State and the informant jointly oppose the prayer and submit that the allegations are there and grievous injury has been received by the informant and in view of that anticipatory bail may kindly be rejected. 9. On perusal of the FIR, it transpires that so far petitioner no.3- Samsher @ Shamshed Ansari is concerned, there are general and omnibus allegation against him and main allegations are against the other accused persons. 10. Accordingly, the petitioner no.3- Samsher @ Shamshed Ansari is directed to surrender before the learned court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Deoghar, in connection with Devipur P.S.
