JUSTICE ANJAN MONI KALITA ORDER Date : 24.02.2026 1. Heard Mr. P. P. Medhi, learned counsel for the accused applicant. Also heard Mr. R. J. Baruah, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023, praying for pre-arrest bail to the accused applicant in Page No.# 2/3 connection with Dispur P.S. Case No. 802/2025 under Section 108 of BNS Act, 2023. 3. The FIR dated 01.10.2025 was lodged in this case, wherein it is stated that the informant’s sister was staying in a rented house belonging to one Ms. Mansi Basumatary and was found hanging therein. It is further stated that the informant’s sister had solemnized a court marriage with the accused applicant, and the date for the traditional marriage ceremony had also been fixed. However, the accused applicant allegedly demanded Rs. 5,00,000/- and tried to delay the traditional marriage. Due to the aforesaid acts, the victim suffered mental distress, which ultimately led to her untimely death. 4. It is seen that a co-ordinate bench of this Court, vide order dated 08.01.2026, has allowed the accused applicant to go on interim bail. In terms of the aforesaid interim protection, the accused applicant has already appeared before the Investigating Officer and got his statements recorded. 5. Mr. Medhi, learned counsel for the accused applicant, submits that the accused applicant is fully cooperating with the investigation and shall continue to appear as and when called for in connection with the investigation in future. 6. Mr. R. J. Baruah, learned Additional Public Prosecutor for the State of Assam, on the other hand, opposes the bail, submitting that the materials in the Case Page No.# 3/3 Diary suggest the active involvement of the accused applicant in abetting the suicide of the victim girl. 7. This Court has perused the Case Diary submitted before it and has also heard the submissions made by the counsel appearing for the respective parties. 8. On consideration of the matter in its entirety, this Court is of the considered opinion that the interim protection granted, vide order dated 08.01.2026 should be made absolute at this stage. Accordingly, the same is made absolute on the same terms and conditions as mentioned in the order dated 08.01.2026. 9. In view of the aforesaid directions, the instant Anticipatory Bail application is disposed of as allowed. JUDGE Comparing Assistant
