For the petitioner: Mr. Vikas Rajput, Advocate. For the respondents: Mr. Raman Jamalta, Advocate. Ranjan Sharma, Judge Petitioner-Mahesh Kumar, has filed O.A. No.5892 of 2016, before Himachal Pradesh Administrative Tribunal and upon abolition of the Tribunal, the matter has been transferred to this Court as CWPOA No.404 of 2020, seeking the following reliefs:- “7 (a) That regularization order of applicant may kindly be modified and his service may kindly be regularized w.e.f. 1-1-2013 or in alternative service of applicant may kindly be regularized immediately on completion of six years of service similarly done in case of other contractual employee as per policy; (b) That all consequential benefits like seniority, pay fixation etc. and difference 1 Whether reporters of Local Papers may be allowed to see the judgment? 2 2026:HHC:39800 in salary may be released in form of arrears; (c) That service of applicant may be regularized as Mechanical helper and not as washer boy.” 2. Without going into the merits of controversy, Learned Counsel for the petitioner, On Instructions, states that case of the petitioner is covered by the judgment dated 26.05.2025, passed by a Division Bench of this Court in CWPOA No.5730 of 2020, titled as Hem Chand Versus Himachal Road Transport Corporation alongwith connected matters and the petitioner shall be satisfied, in case, the Respondents examine/consider the case of the petitioner in the light of judgment in the case of Hem Chand [supra]. [Statement Taken on Record]. 3. Per contra, Learned Counsel for the Respondents- Corporation states that subject to verification of facts and applicability of the judgment, in the case of Hem Raj [supra], the Respondents-Corporation shall examine the claim of the petitioner. In above backdrop and leaving all questions open, this Court disposes of the instant petition with a direction to Respondent No.1-Managing Director, Himachal Road Transport Corporation, to examine/consider the case 3 2026:HHC:39800 of the petitioner in the light of judgment in the case of Hem Chand [supra], after verification of facts and subject to applicability of the said judgment to the present petitioner, within six weeks from today.
