It has been submitted by learned counsel for the petitioners that the learned Sessions Judge, Kupwara was on leave yesterday, therefore, the petitioners have approached this Court. Upon enquiry, it has been found that learned Sessions Judge, Kupwara has joined his duties. Therefore, this application, in view of the law laid down by Supreme Court in judgment titled “Jagdeo Prasad vs. State of Bihar and Others” is not maintainable and is accordingly dismissed, leaving it open to the petitioners to approach the court of first instance.
