Case No. 68 of 2025 for the offence registered under Sections 80, 3(5) of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate, 1st Class, Palamau, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that as per the post-mortem examination report, death was suicidal in nature caused by hanging. There is no allegation of any dowry demand in the FIR. Therefore, the charge under Section 80 of the BNS will not be sustainable. The allegation of homicidal death is falsified by the post-mortem examination report. Learned A.P.P. opposed the bail petition. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
