For the Respondents: Mr. Raman Jamalta, Advocate. ------------------------------------------------------------------------------------ Jyotsna Rewal Dua, Judge The petitioner has prayed for following substantive relief: - "That the directions may kindly be issued to the respondents to grant pension to the petitioner as per Rule 44(8) of Pension Rules Central Civil Services (Pension) Rules, and to release the pension to the Petitioner w.e.f. 01.05.2024 with all pensionary benefits along with interest @12% per annum." 2. Learned counsel for the respondents has placed on record office instructions dated 17.09.2026, relevant portion of which reads as under: - "In continuation to this office letter NO:HO:FUND/K-50200- 2025-26/ Sh. Krishan Kumar. Driver, dated 18.06.2026. (PPO No. 20200). You are request to pay remaining amount of Rs. 4,71,608/-(Four Lakh Seventy One Thousand Six Hundred and Eight) only with immediate effect out of total payment of Rs. 5,89,510/- only and different amount Rs. 1,17,902/-(589510- 1Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 471608) has already been disbursed to Sh. Krishan Kumar, Driver. The above amount may be debited from HRTC account No. 20002001515." Learned counsel for the respondents submits that the amount payable in terms of the aforesaid office instructions shall be credited to the bank account of the petitioner within one week from today. Learned counsel for the petitioner submits that the aforesaid office instructions, coupled with submissions made by learned counsel for the respondents, have redressed the grievance of the petitioner and, insofar as the remaining grievance of the petitioner is concerned, the petitioner may be reserved liberty to seek appropriate remedy, in accordance with law. Granting liberty as prayed for, the present petition to stand disposed of. Pending miscellaneous application(s), if any, shall also stand disposed of.
