This misc. bail application has been filed by the petitioner Guddu Yadav S/o Shyamlal, aged about 55 years, who was arrested by the police since long in connection with the FIR bearing No.56/2026 dated 19.01.2026 registered at Police Station Kotwali Baran, District Baran for the offences punishable under Sections 115(2), 126(2), 352, 189(2) and 109(1) of B.N.S. and Section 3(1)(r), 3(1)(s) and 3(2)(v) of the SC/ST Act. 2. Learned counsel for the petitioner submitted that there is a civil dispute pending between the parties, on account of which, the incident as mentioned in the FIR took place, wherein the family members and relatives of both the parties sustained certain injuries. He further submitted that there have been previous civil disputes between the parties which have already been decided. Learned counsel further submitted that the allegations mentioned [2026:RJ-JP:10954] (2 of 3) [CRLMB-2342/2026] in the FIR are of a general nature and that persons from both sides have sufferred certain injuries. Both the parties have been residing in the same village for many years and the petitioner has no criminal antecedents of any nature. In view thereof, learned counsel for the petitioner prayed that the petitioner be enlarged on bail. 3. Learned Public Prosecutor strongly opposed the bail application. 4. Be that as it may. 5. This Court, after considering the fact that cross FIRs were lodged by both the parties in respect of the same incident on the same day and that general allegations have been levelled against the petitioner and the other persons in the respective FIRs from both the sides, trial will take sufficiently long time, the petitioner is behind the bar since 19.01.2026, there are no criminal antecedents against him. Considering the overall facts and circumstances of the case and also taking into account that their exists civil disputes between the parties on account of which the said incident took place. This Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner Guddu Yadav S/o Shyamlal on bail. 6. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Guddu Yadav S/o Shyamlal shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each [2026:RJ-JP:10954] (3 of 3) [CRLMB-2342/2026] and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty.
