Heard Mr.Moses Angam, learned counsel for the petitioner.
By the present petition, the petitioner, who is an employee of Postal Department, Government of India challenged the date of retirement w.e.f. 1.3.2025 on attaining age of 65 years on the ground that date of birth reflected in the Service Record is not correct.
Mr.B.R.Sharma, learned CGSC has pointed out that as per Rule 154(b) of the Central Administrative Tribunal Rules in Category (B) (11), service matter of Ministry of Communications falls within the jurisdiction of Central Administrative Tribunal. Learned CGSC submits that Postal Department is one of the Departments under the Ministry of Communications and present petition is to be filed before the Central Administrative Tribunal at Guwahati.
At this stage, Mr.Angam, learned counsel for the petitioner, on instruction, seeks leave of this Court to withdraw the writ petition so as to enable him to approach the appropriate forum.
Mr.B.R.Sharma, learned counsel for the respondent has no objection.
In the circumstance, the writ petition is dismissed as withdrawn with liberty to approach the appropriate forum.
