By way of this petition, the petitioners seek the following reliefs : 10.1 That, this Hon'ble Court may call for the entire record(s) of the proceedings drawn before the Court of the Respondent No. 02 i.e., the SDO(R), Abhanpur, District- Raipur, (C.G.) in Revenue Case No. 202602111100175 and Revenue Case No. 202510111100110, in the interest of justice. 10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, order or direction to quash and set aside the impugned order dated 24-04-2026 (Annexure- P/1) passed by the Respondent No. 02 in Revenue Case No. 202602111100175, in the interest of justice; 10.3 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, order or direction to quash and set aside the Eviction Warrant dated 04-06-2026 (Annexure- P/7) issued by the Respondent No. 03 against the Petitioners, in the interest of justice; 10.4 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, order or direction to declare that the second application filed by Respondent No. 04 is barred by the principles of Res Judicata, in the interest of justice; 3 10.5 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favor of the petitioner together with cost of the petition, in the interest of justice. 2. Learned counsel for the petitioners submits that he does want to press this petition. However, he seeks liberty in favour of the petitioners to avail the efficacious alternative remedy available to them. He further submits that since an eviction order has been passed against the petitioners, some interim protection may be granted to enable them to approach the appellate authority i.e. the Collector, Raipur. 3. In view of the above, the Writ Petition is dismissed, as not pressed with the liberty prayed for. In order to facilitate the petitioners to approach the appellate forum, it is directed that the effect and operation of the impugned eviction order dated 24.4.2026 shall remain stayed for a period of 15 days from today.
