ORAL ORDER Accused No.1 in Crime No.146/2026 registered by Suryanagar Police Station, Bengaluru, for the offence punishable under Section 108 of the Bharatiya Nyaya Sanhitha, 2023 (hereinafter referred to as 'BNS, 2023' for short), is before this Court in this petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking anticipatory bail.
2. Heard the learned counsel for the petitioner and the learned HCGP for the respondent/State.
3. FIR in Crime No.146/2026 was registered by Suryanagar Police Station, Bengaluru for the aforesaid offence against petitioner and others based on the first information dated 26.04.2026 received from

Rajendrareddy, who is the father of deceased - Leelavathi. Apprehending arrest in the said case, petitioner had filed Crl.Misc.No.5268/2026 before the jurisdictional Sessions Court which was rejected on 12.06.2026. Therefore, he is before this Court.
4. Petitioner herein is the husband of deceased Leelavathi. It appears that Leelavathi and her minor daughter were found dead in a pond situated within the agricultural property of the accused persons. Father of Leelavathi suspected foul play in the death of his daughter and grand-daughter and therefore, approached the police and based on his first information, FIR was registered against the petitioner and his family members for the aforesaid offence.
5. In the first information, there is no mention of any such incident which had taken place immediately prior to the deceased committing suicide, which would have either abetted or instigated the deceased to take the

drastic step of committing suicide. Considering this aspect of the matter, accused Nos. 2 to 4 have been granted anticipatory bail by this Court in Crl.P.No.7466/2026
disposed of on 02.06.2026. Petitioner is said to be an agriculturist and has no other criminal antecedents. He has undertaken to co-operate with the police for the purpose of investigation.
6. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following:
ORDER (a) Petition is allowed. (b) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner / accused No.1 in the event of his arrest in Crime No.146/2026 registered by Suryanagar Police Station, Bengaluru, for the offence punishable under

Section 108 of BNS, 2023, subject to the following conditions:-
1. The petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (One lakh only) with two sureties for the likesum to the satisfaction of the investigating officer.
2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon.
4. The petitioner shall not involve in similar offences in future.
