Petitioner, who is apprehending arrest in Crime No.360/2025 registered by Mysuru South Police Station, Mysuru, for the offences punishable under Sections 69 and 351(3) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.360/2025 was registered by Mysuru Police Station, Mysuru, for the aforesaid offences against the petitioner based on the first information dated 18.12.2025 received from the victim lady, aged about 35 years. Apprehending arrest in the said case, petitioner had filed Crl.Misc.No.28/2026 before the jurisdictional Sessions Court which was rejected on 17.01.2026. Therefore, he is before this Court. 4. A reading of the first information reveals that victim lady got acquainted with the petitioner through social media platform known as 'Snapchat'. He allegedly introduced himself - 3 - HC-KAR NC: 2026:KHC:30757 CRL.P No. 1021 of 2026 as a software engineer and had proposed to marry the victim lady. Thereafter, he allegedly took her to various places and had sexual intercourse with her, with a promise to marry her and as a result, she conceived. She has alleged that her pregnancy was aborted subsequently in Motherhood Hospital at Yadavagiri. Thereafter, when she insisted the petitioner to marry her, he allegedly informed her that he is already married and she is the 23rd girl with whom he had an affair. It is under these circumstances, the victim lady had approached the police and submitted first information, based on which FIR in Crime No.360/2025 was registered. 5. Petitioner is a married man having wife and children. The allegation against the petitioner is that he had promised to marry the victim lady and had sexual intercourse with her. Since petitioner was already married, promise made by him to the victim lady was fake and by inducing her with fake promise, he had sexual intercourse with her. The allegations now found in the first information therefore prima facie attracts the offence punishable under Sections 69 and 351(3) of BNS, 2023. Though FIR has been registered in the month of December, - 4 - HC-KAR NC: 2026:KHC:30757 CRL.P No. 1021 of 2026 2025, itself, petitioner has not been cooperating with the police for the purpose of investigation and there is no much progress in the investigation of the case. Considering the nature of allegations found as against the petitioner, who is a married man, I am of the opinion that his prayer for grant of anticipatory bail cannot be entertained.
