By filing this writ petition, the petitioners have prayed for the following reliefs:-
“for issuance of a writ of or in the nature of mandamus or for any other appropriate writ,
order or direction commanding/ directing the Settlement Officer, Dhanbad (Respondent No.5) to accept and register the petitioners’ Suit under section 87(1) of the Chota Nagpur Tenancy Act, 1908, challenging the entries

made in Record of Rights (Khatian) in Revisional Survey finally published vide Notification No.423 dated 17.07.2014 of Government of Jharkhand, in respect to the New Khata No.92, New Plot No.1414, Area 16 decimal, Mouza Bandhgora, Thana No.35, P.S. Pindrajora, District Bokaro; as also for issuance of such other writ, order or direction as may appear just and proper for doing equitable justice to the petitioners.”

Heard learned counsel representing the petitioners and
learned counsel representing the respondents.

The only grievance of the petitioners is that the Settlement Officer, Dhanbad, is not accepting and registering the petitioners’ suit filed under Section 87(1) of the Chota Nagpur Tenancy (CNT) Act, 1908, whereby they had challenged the entries made in the Record of Rights (khatiyan).

Learned Senior Additional Advocate General, submits that under Section 87 (1) of the CNT Act, the application has to be filed before a Revenue Officer, and in terms of Rule 30 along with Note-1 of the Chota Nagpur Tenancy Rules, 1959, all the Deputy Collectors in the Chota Nagpur Division, have been empowered to discharge the function of a Revenue Officer under Chapters-XII and XIV of the CNT Act.

Learned counsel representing the petitioners submits that the petitioners have filed an application before the Settlement Officer, Dhanbad, who is in the rank of a Deputy Collector, and powers have been vested upon him.

Considering the aforesaid submission, I direct respondent

No.5 – Settlement Officer, Dhanbad, who is also the Revenue Officer, to register the application of the petitioners and thereafter decide the same strictly as per law considering the Limitation and the other aspects.

With the aforesaid direction, this writ petition stands
disposed of.
