Heard the parties. 2. The present writ petition has been filed for the following reliefs:- “(i) quashing and setting aside the letter dated 07.01.2026 as contained in Letter No. SARB/10201/RK/ODD/793 issued under the hand and signature of the Respondent No.2, whereby the agricultural property of the petitioner has been again put up for public auction to be conducted on 28.01.2026 (Annexure-37), as arbitrary, illegal and setting aside the same with all consequences. (ii) Quashing/setting aside all actions taken under the SARFAESI Act against the said property. (iii) The respondent Bank be directed to rescind, recall and/or withdraw all steps taken against the said property of the Applicant. (iv) The respondents/their men and agents be restrained from taking possession of the property of the petitioner.” 3. The main stress of the petitioner is the auction notice which has been issued by the respondents. 2026:JHHC:2251 2 W.P.(C) No.494 of 2026 4. It has been informed by the learned counsel for the respondents that the auction process had been scheduled yesterday i.e. 28.01.2026 but nobody has turned up and no new date has been announced. Auction has already failed. 5. Thus, there is no immediate requirement of any interim order. 6. The writ petitions are being maintained by this Court only on the consideration that the Debt Recovery Tribunal is not functional and that for the limited purpose to grant interim relief or immediate relief to the affected person, so that the subject matter survives. 7. Since, there is no immediate threat, I am not inclined to entertain the present writ petition. Accordingly, the same is, hereby, dismissed. 8. However, if there is immediate threat, the petitioner is at liberty to approach this Court, if the Debt Recovery Tribunal remains non functional.
