1. This is a petition in terms of Section 11(6) of Arbitration and Conciliation Act, 1996 [“the Act”], seeking appointment of an independent Arbitrator for adjudication of disputes that have arisen between the parties in reference to contract work namely “Provision of Wall and Allied Infrastructure at Drugmulla” arising out of agreement No. CESZ-09/2016-17 and allotment letter dated
20.03.2017.
2. The factum of dispute, having arisen between the parties in reference to the work in question, is not in dispute nor is the existence of arbitration clause in the agreement in dispute between the parties. In the petition, filed by the petitioner, the petitioner has suggested three names of retired Engineers for appointment of one of them as sole Arbitrator. The names, as proposed by the petitioner, are as under: Serial No. 03

3. Ms. Rehana Qayoom, Advocate appearing vice Mr. T. M. Shamsi, learned DSGI submits that she has instructions from the respondents to agree upon the name of Shri Arvind Kumar Arora, Retd DG (Pers), MES, whose contact details are MES, B-333, Chittaranjan Park, New Delhi, 110019, Mobile No. 8130588577 and Email: arvindarora2016@gmail.com.
4. In view of the aforesaid, this petition is disposed of and with the consensus of the parties, Shri Arvind Kumar Arora, Retd DG(Pers), MES is appointed as Arbitrator. The Arbitrator would enter upon the reference and adjudicate upon the dispute between the parties arising out of the contract in question.
5. A copy of this order shall be served upon learned Arbitrator, who shall proceed in the matter in accordance with law and make his award within the stipulated period. He shall be entitled to fee according to Schedule 4 of the Act.
