The instant writ application has been filed by the petitioners for the following reliefs:
“1a. For issuance of a writ in the nature of mandamus or any other appropriate writ, order or direction upon the respondents to forthwith release and pay the admissible gratuity amount payable to the Petitioner along with statutory interest consequent upon his retirement from service on 30.11.2024 from the post of Assistant Engineer, Gramin Vikas Vishesh Pramandal, Sahebganj; and b. For issuance of any other appropriate writ/order/direction as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case..”

Learned counsel for the petitioner submits that the issue involved in this writ application is squarely covered by the judgment passed by the Hon’ble Apex Court in “State of Jharkhand & Ors. v. Jitendra Kumar Srivastava & Ors.”1. Accordingly, the petitioner may be permitted to approach the respondent no.2 so that he can pass the
order in the light of judgment rendered in above referred case.

Learned counsel for the respondents submits that since no counter affidavit has been filed as such the petitioner may approach the concerned respondent and if the case of the petitioner is covered by the aforesaid judgment, necessary order will be passed by the concerned respondent.

Having regard to the aforesaid, the instant writ application is hereby disposed of by directing the petitioner to approach the 2nd Respondent by filing a detailed representation and the judgment to be relied upon by him. The moment 2nd Respondent receives such representation, he shall take a decision in the matter in accordance with law and applicable Rules and Regulations and also in the light of the
judgment passed by the Hon’ble Apex Court in “Jitendra Kumar Srivastava”(supra). The entire exercise shall be completed within a period of 6 weeks from the date of receipt/production of copy of this order.

It goes without saying that if the claim of the petitioner is found to be genuine, necessary consequential order be issued within a further period of 3 weeks.
