Roy, Advocate Mr. Kishore Kr. Singh, SC-V ------ 19/ 17th August, 2026 1. Heard the parties. 2. By filing this writ petition, the petitioners have prayed to restrain the respondents from installing the high-tension transmission towers on the lands which belong to the petitioners, without making any acquisition and without the consent of the petitioners. Further, the petitioners pray for compensation. 3. It is the grievance of the petitioners that the respondent- Jharkhand Urja Sancharan Nigam Limited has installed high-tension transmission tower and has laid 132 KV lines over the land of the petitioners which is creating a hindrance to the petitioners in lawfully enjoying their properties. He submits that the said high-tension wires have been laid without taking ‘No Objection’ from the petitioners and without paying any compensation. 2026:JHHC:24594 Page | 2 4. Learned counsel appearing on behalf of Jharkhand Urja Sancharan Nigam Limited by referring to Page No.61 & 62 of the counter-affidavit, submits that so far as the petitioners are concerned, a compensation has been assessed to the tune of Rs.22,848/- in July, 2018, but the petitioners have refused to receive the said money. 5. He further submits that the construction line has already been laid and the electricity transmission has been installed. 6. After hearing the parties, I find that the compensation has already been assessed by the respondents. The petitioners may object the quantum but he cannot stall the installation process. 7. Now admittedly, the installation process is already over. Thus, the petitioners should receive the compensation amount, may be under protest, and if the petitioners want enhancement of compensation amount, they may approach the appropriate forum. 8. With the aforesaid observation, this writ petition stands disposed of. 9. The amount admitted will be disbursed to the petitioners with an interest with 7% per annum, from the date of assessment till payment.
