JUSTICE S VISHWAJITH SHETTY ORAL ORDER This petition is filed under Section 483(1)(b) of Bharatiya Nagarik Suraksha Sanhita, 2023 by accused No.28 in Crime No.384/2025 registered by CEN Police Station, Bangalore for offences punishable under Sections 66(C), 66(D), 84(B), of Information Technology Act, 2000 and Sections 61(2), 318(4), 319(2) read with Section 3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 with a prayer to modify/relax condition No.1 imposed by LXV Additional City Civil & Sessions Judge, Bengaluru City in Criminal Miscellaneous No.3423/2026 disposed of on 07.05.2026. 2. Heard the learned counsel appearing for the petitioner and the learned High Court Government Pleader appearing for the respondents. 3. The petitioner herein had filed Criminal Miscellaneous No.3423/2026 before jurisdictional Sessions Court at Bangalore, apprehending arrest in Crime - 3 - HC-KAR NC: 2026:KHC:30923 CRL.P No. 7616 of 2026 No.384/2025 registered by CEN Police Station, Bangalore. The Learned Sessions Judge, vide Order dated 07.05.2026, had allowed Criminal Miscellaneous No.3423/2026 and had granted anticipatory bail to the petitioner in the said case subject to certain conditions. Condition No.1 imposed by the learned Sessions Judge in Criminal Miscellaneous No.3423/2026 reads as under: "1. The petitioner shall appear before the investigating officer on every 1st and 3rd Saturday of every month for 3 months or till filing of final report after the investigation whichever is earlier. " 4. The petitioner is before this Court seeking relaxation/modification of the said order. 5. Learned counsel for the petitioner submits that petitioner has co-operated with the Investigation Officer for the purpose of investigation and charge sheet is also filed. He submits that petitioner is a resident of Rajasthan and condition No.1 imposed on him has been causing hardship to him. He also submits that petitioner is ready and willing to - 4 - HC-KAR NC: 2026:KHC:30923 CRL.P No. 7616 of 2026 appear before the Investigation Officer in compliance of condition No.1 on every third Saturday of the month. 6. Submission of learned counsel for the petitioner is placed on record. 7. Learned High Court Government Pleader fairly does not oppose the prayer made on behalf of the petitioner. 8. Under these circumstances of the following: ORDER 1. The Criminal Petition is partly allowed. 2. Condition No.1 imposed by LXV Additional City Civil & Sessions Judge, Bengaluru City in Criminal Miscellaneous No.3423/2026 disposed of on 07.05.2026 shall read as follows: (i) The petitioner shall appear before the Investigation Officer on every third Saturday of the month for a period of 3 months from the date of the order passed in Criminal Miscellaneous No.3423/ 2026. - 5 - HC-KAR NC: 2026:KHC:30923 CRL.P No. 7616 of 2026 3.
