1. Today this Writ Petition is listed for consideration on IA No.8/2024, application under Order 6 Rule 17 of the CPC seeking amendment in the writ petition. 2. Learned counsel for the petitioner would submit that by way of amendment the petitioner is making prayer to amend the writ petition to challenge the order dated 21.2.2020 passed by the NCLT, Cuttack Bench. 3.
In the present Writ Petition, the petitioner has prayed for the following reliefs:-
“(i) Be pleased to issue a writ of mandamus or any other appropriate writ holding and/or declaring that the Sale Notice dated 8.2.2020 issued by the Respondent no.3 as illegal, arbitrary and violative of the Petitioner’s right decreed under the award dated 28.9.2017 and consequentially quash the impugned sale notices to the extent it seeks to auction the Biomass Power Plant (8 MW Capacity) (Annexure P- 9); and /or (ii) Be pleased to issue a writ of mandamus or any other appropriate writ directing and commanding and or directing that the Respondent no.2 and 3 to comply with the terms and conditions of the arbitral award dated 28.9.2017 and consequentially quash the impugned sale notices to the extent it seeks to auction
3 the Biomass Power Plant (8 MW Capacity) (Annexure P-9); and/or (iii) Any other relief which this Hon’ble Court may deem fit in the facts and circumstances of the case along with cost of the petition.”
4. During the course of arguments, learned counsel for the petitioner fairly submits that as there was no interim order, now all the sale proceedings have been completed. 5. At this stage, learned counsel for the petitioner further submits that as subsequent to filing of the present writ petition, the NCLT, Cuttack Bench has passed an order on 21.2.2020, therefore, he may be permitted to withdraw the writ petition to challenge the order passed by the NCLT, Cuttack Bench, by way of separate proceeding, in accordance with law. 6. In view of the submission made by learned counsel for the petitioner, the Writ Petition is dismissed as withdrawn. Sd/- (Parth Prateem Sahu) Judge Barve
