JUSTICE D K SINGH) The present intra Court appeal is filed impugning the order dated 14.03.2025 passed by the writ Court in W.P.No.31783/2024. - 4 - HC-KAR NC: 2026:KHC:17780-DB WA No. 666 of 2025 2. The petitioner who claims to be the devotee of Chowdeshwari temple, Nekkundi Village, Kasaba Hobli, Chintamani Taluk, Chikkaballapur District, has laid challenge to the order 22.09.2023 passed by respondent No.1 (Annexure-A) and for a mandamus directing respondent No.1 to consider the representation dated 26.06.2023. 3. The main ground urged in the writ petition was that the respondent Nos.4 and 5 claiming their rights by means of created documents such as order dated 19.08.1982, passed by the Land Tribunal conferring the occupancy rights in favour of respondent Nos.4 and 5. It appears that respondent Nos.4 and 5 have also filed civil proceedings and they ultimately succeeded in RSA.No.237/2013 before this Court. 4. The learned Single Judge has observed that the Deputy Commissioner has recorded the evidence that - 5 - HC-KAR NC: 2026:KHC:17780-DB WA No. 666 of 2025 respondent Nos.4 and 5 were the beneficiaries of order passed by the Land Tribunal dated 19.08.1982. 5. The Deputy Commissioner has rejected the plea of the petitioner for revision inasmuch as the petitioner had approached the Deputy Commissioner after 22 long years from the date of the order i.e., 19.08.1982, conferring occupancy rights in favour of respondent Nos.4 and 5. 6. The learned Single Judge has noted all these facts and dismissed the writ petition. We see no reason to interfere in this writ appeal and therefore, the same is dismissed without cost. If petitioner's right to perform pooja etc., is infringed, in any manner, the petitioner may take appropriate proceedings before the competent Court/Forum. - 6 - HC-KAR NC: 2026:KHC:17780-DB WA No. 666 of 2025 In view of the dismissal of the appeal, pending I.A., if any, does not survive for consideration and the same is disposed of.
