In this petition, filed in terms of Section 11(6) of the Arbitration and Conciliation Act, 1996 [“the Act”], the petitioner seeks appointment of an independent Arbitrator to adjudicate and resolve the disputes between the parties, having arisen in respect of work namely “Provision of 49 Bedded Hospital, including Lift, Central AC Plant, Hot Water Supply, Fire Hydrant, Sprinkler System, Fir Alarm System and External Services at Bhaderwah”, which was allotted to the petitioner vide allotment No. CEUZ/UDH/04/2010-2011.The petitioner has, in paragraph 13 of the petition, proposed five names of Engineers for such appointment. 2. Mr. Vishal Sharma, learned DSGI for the respondents has no serious objection to the appointment of the independent Arbitrator. He also agrees with the appointment of Sh. MCT Pareva, ADG, CPWD Serial No. 03 2 Arb P No. 83/2026 (Retd.), whose contact details are G-1/38, Sector 15, Rohini, Delhi- 110089, Mobile No. +91 9910337676 and Email mctpfeb05@rediffmail.com as Arbitrator. 3. In view of the aforesaid and with the consent of the parties, Sh. MCT Pareva, ADG, CPWD (Retd.) is appointed as Arbitrator. The Arbitrator would enter upon the reference and adjudicate upon the dispute between the parties arising out of the contract in question 4. A copy of this order shall be served upon learned Arbitrator, who shall proceed in the matter in accordance with law and make his award within the stipulated period. He shall be entitled to the fee according to Schedule 4 of the Act. 5. Disposed of.
