[2026:JHHC:24964] IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No.6684 of 2026 ------ Mahesh Kumar Tanti, aged about 62 years, S/o- Late Madan Lal Tanti, R/o- Gulli Bhatta, P.O. & P.S. – Sahibganj (T), District – Sahibganj, Jharkhand. .... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Anurag Kashyap, Advocate Ms. Supriya Dayal, Advocate For the State : Mrs. Vandana Bharti, Addl.P.P For the Informant : Mr. Jai Shankar Tripathi, Advocate Mr. Amandeep Kr. Pandey, Advocate ------ Order No.03 Dated:-19-08-2026 Heard the parties. The petitioner has been made accused in connection with S.T. Case No. 167 of 2025 arising out of Jirwabari P.S. Case No. 06 of 2025 registered for the offence punishable under Sections 103(1), 238, 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act. This is the second journey of the petitioner with the prayer for regular bail. Earlier the prayer for regular bail of the petitioner was rejected on merit by this Court vide order dated 09.06.2025 passed in B.A. No. 3865 of 2025. Learned counsel for the petitioner submits that the fresh ground is that in the meanwhile, charge has been framed against the petitioner and he has been in custody for some more time. It is next submitted that the allegation against the petitioner is false. It is further submitted that the petitioner has been in custody since 05.01.2025 as mentioned in para-24 of the instant bail application. It is lastly submitted that the petitioner is ready and willing to co-operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail. Learned counsel appearing for the State and the learned counsel for the informant on the other hand oppose the prayer for bail of the petitioner and submit that the mere fact that the charge has been framed against the petitioner is an aggravating factor and not a mitigating factor to reconsider the prayer for bail of the petitioner which has already been rejected by this Court on merits vide order dated 09.06.2025 passed in B.A. No. 3865 of 2025. It is next submitted that keeping in view the serious nature of allegation against the petitioner of committing murder of the deceased, there is every chance of the petitioner absconding and tampering with the evidence, if released on bail. Hence, it is submitted that the petitioner ought not to be released on bail. Considering the facts of this case, this Court is of the considered view that the mere fact that charge has already been framed against the petitioner and he has remained in custody for some more time are not sufficient grounds to admit the above named petitioner on bail which has already been rejected on merit by this Court. Accordingly, the prayer for bail of the above named petitioner is rejected at this stage. (Anil Kumar Choudhary, J.) Dated:- 19.08.2026 Saroj/
