Accused No.1 in SC No.854/2024 pending before the 74th Additional City Civil and Sessions Judge, Mayo Hall Unit, Bengaluru, arising out of Crime No.283/2024 registered by the Mahadevapura Police Station, Bengaluru, for the offences punishable under Sections 201, 302 of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and learned HCGP on behalf of respondent - State. 3. FIR in the present case Crime No.283/2024 was registered by the Mahadevapura Police Station, Bengaluru, for the aforesaid offences against unknown person based on the first information dated 29.03.2024 received from Mahesh P.M, Police Officer attached to Mahadevapura Police Station. During the course of investigation, the petitioner herein was arrested - 3 - HC-KAR NC: 2026:KHC:31109 CRL.P No. 4218 of 2026 on 29.03.2024 and remanded to judicial custody. After completion of the investigation, charge sheet was filed as against the petitioner for the aforesaid offences. His bail application before the jurisdictional Sessions Court in Crl.Misc.No.25122/2026 was rejected on 02.03.2026. Therefore, he is before this Court. 4. FIR in the present case was registered against unknown person after the dead body of an unknown male was found within the jurisdiction of Mahadevapura Police Station. During the course of investigation, the petitioner was arrested on 29.03.2024 and remanded to judicial custody. In the charge sheet which is filed subsequently, it is stated that on 25.03.2024 at about 9.30 pm., the deceased, who was a stranger was found trying to enter the houses in the locality. The CCTV footage collected by police shows that the deceased was half naked and he was throwing the belongings of the housemates. Therefore, the petitioner allegedly caught hold of the deceased and after dragging him outside, allegedly assaulted him with his hands and when he fell down allegedly kicked him on his chest and other parts of the body. - 4 - HC-KAR NC: 2026:KHC:31109 CRL.P No. 4218 of 2026 5. Undisputedly, the petitioner had no ill will or motive against the deceased. It is only after the deceased, who was half naked tried to enter the houses in the locality, the petitioner had dragged him outside and assaulted him with his hands and legs and as a result, the deceased, who had suffered injuries had died. It is not the case of the prosecution that the petitioner has assaulted the deceased with any weapon. The petitioner is aged 25 years, who has no criminal antecedents, is in custody for more than two years. 6. Under the said circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following: The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.283/2024 of Mahadevapura Police Station, Bengaluru, for the offences punishable under Sections 201 and 302 of IPC, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 5 - HC-KAR NC: 2026:KHC:31109 CRL.P No. 4218 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
