This writ petition has been preferred by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:- “10.1 That, the Hon’ble Court may kindly be pleased to allow the instant writ petition in the interest of justice. 10.2 That, the Hon’ble Court may kindly be pleased to quash the order dated 29.09.2025 passed by the Collector Rajnandgaon in Rev. Case No.E-202206090100019/B-121/year 2021- 22. 10.3 That, the Hon’ble Court may kindly be pleased to allow the writ petition and kindly be pleased to stay the construction of Foodpark on Kh. No.349/2, area 1.214 hectare, situated at Village Bejetala, H.P. Learned counsel for the petitioner submits that petitioner has preferred an appeal on 29.01.2026 against the order dated 29.09.2025 before the Commissioner, Durg Division, which is pending consideration. She further submits that the land of the petitioner, which has been allotted to him, upon which, respondents are raising construction on full part without granting any compensation to the petitioner, though earlier compensation has already been calculated, therefore, she prays that concerned Commissioner may be directed to decide the matter expeditiously within the stipulated period specified by this Court. 4. Learned State counsel has raised formal objection with regard to the submission made by the counsel for the petitioner. 5. Considering the aforesaid aspect of the matter, this writ petition is disposed of directing Commissioner, Durg Division to dispose of the appeal, which has been filed by the petitioner before him on 29.01.2026, expeditiously preferably within a period of 3 months from the date of passing of this order. 6. With the aforesaid observation and direction, the instant writ petition stands disposed of. 7. Interlocutory application(s), pending if any, also stands disposed of.
