ORAL ORDER
1. Accused no.3 in Crime No.267/2017 registered by Kalasipalya Police Station, Bengaluru City, for the offences punishable under Sections 341, 504, 506, 307 read with 34 of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned Counsel for the parties.
3. FIR in Crime No.267/2017 was registered for the aforesaid offences against unknown persons based on the first information received from CW-1 - Angu Shabareesh. After completing investigation, charge sheet was filed in the said case against three persons and petitioner is arrayed as accused no.3 in the charge sheet. Since, the petitioner had not appeared before the committal court, coercive steps were taken against him and his presence was secured on 11.03.2026 and on the said date, he was remanded to judicial custody. Bail application filed by the petitioner before the jurisdictional Sessions Court in Crl. Misc. No.2725/2026 was rejected on
01.04.2026. Therefore, he is before this Court.

Perusal of the material on record would go to show that on 05.12.2017 at about 10.00 p.m., when CW-1 was riding his bullet motor bike on Chikkamavalli Susheela Road, within the jurisdiction of Kalasipalya Police Station, accused nos.1 to 3 who came in another two wheeler allegedly abused him using filthy language and asked him to take back his two wheeler. Thereafter, in the quarrel that took place between the two parties, accused no.1 allegedly assaulted CW-1 with a knife and caused injuries to him. There is no allegation against accused nos.2 & 3 about assaulting CW-1 and causing injuries. Petitioner is arrayed as accused no.3 in the charge sheet which is filed showing him as absconding. Since petitioner had not appeared before the committal court after the charge sheet was filed, coercive steps were taken against him and he was arrested and produced before the Court on 11.03.2026 and remanded to judicial custody.

Learned Counsel for the petitioner has submitted that petitioner was not at all aware of the criminal case pending against him and he has no other criminal antecedents. Considering the nature of allegations found as against the

petitioner in the charge sheet which is filed in Crime No.267/2017, and also taking into consideration that he is now in custody for the last more than three months, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively, subject to appropriate conditions. Accordingly, the following order:
6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.267/2017 registered by Kalasipalya Police Station, Bengaluru City, for the offences punishable under Sections 341, 504, 506, 307 read with 34 of IPC, subject to the following conditions:
a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
