1. Petitioner has filed this writ petition seeking following reliefs:-
"10.1. That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondents to consider
and
grant
compassionate appointment to the petitioner in an appropriate post commensurate with her qualifications, within a stipulated time frame, in light of the demise of her sister Late Lekha Kumar Tonday on 09.05.2023 and her application dated 10.02.2026 (Annexure P/4). 10.2 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate."

Learned counsel for the petitioner submits that the present writ petition has been filed seeking a direction to the respondents to consider and grant compassionate appointment to the petitioner consequent upon the death of her sister, Late Ms. Lekha Kumari Tondey, who was serving as a Lecturer at Government Girls Higher Secondary School,
3 Marwahi, District Gaurela-Pendra-Marwahi (C.G.) under respondents No. 4 and 5.

Learned counsel further submits that the deceased employee, Late Ms. Lekha Kumari Tondey, was unmarried and is survived by three brothers and three sisters, all of whom were dependent upon her. It is submitted that the petitioner, being one of the dependants of the deceased employee, submitted an application seeking compassionate appointment; however, the said application has not been considered by the respondents till date.

Learned counsel for the respondent/State, on instructions and by referring to page No. 23 of the writ petition, submits that the petitioner's application for compassionate appointment has not yet been considered as the same is incomplete. It is submitted that by communication dated 23.04.2026, the petitioner was informed that, although the application had been submitted in the prescribed format, it did not bear the signature of the Head of Office. Since the deceased employee, Late Ms. Lekha Kumari Tondey, was serving as Lecturer at Government Girls Higher Secondary School, Marwahi, District Gaurela-Pendra-Marwahi (C.G.), the petitioner was directed to
4 submit her application for compassionate appointment through the Principal of the said school to the District Education Officer, Gaurela-Pendra-Marwahi, in accordance with the prescribed procedure. It is further submitted that, upon submission of the application through the proper channel, the same shall be considered and decided expeditiously, preferably within a period of 45 days from the date of its receipt.

In view of the aforesaid submission made by learned State counsel, the present writ petition is disposed of with a direction to the petitioner to submit her application for compassionate appointment through the proper channel, as required under the communication dated 23.04.2026. Upon receipt of such application, the competent authority shall consider and decide the same in accordance with law, preferably within a period of 45 days.
