CORAM: HON'BLE MR. JUSTICE S VISHWAJITH SHETTY
ORAL ORDER
1. Accused No.2 in Crime No.539/2026 registered by the Byadarahalli Police Station, Bengaluru, for offences punishable under Sections 103(1) read with 3(5) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and the learned HCGP for respondent. 3. FIR in Crime No.539/2026 was registered by the Byadarahalli Police Station, Bengaluru, for the aforesaid offence against one Parvathamma and the petitioner herein based on the first information received on 16.11.2025 from one Somashekar, son of deceased Venkatesh. accused No.2 in the said charge sheet. His bail application filed before the jurisdictional Trial Court in Crl.Misc.No.526/2026 was rejected on 25.03.2026. Therefore, he is before this Court. 4. The material on record would reveal that deceased Venkatesh had an illicit relationship with accused No.1 after his wife's death. He allegedly had promised to marry accused No.1 and had continued his relationship. On 16.11.2025 accused No.1 along with the petitioner herein, who is her uncle came near the house of deceased at about 7.30 p.m., and quarreled with him for the reason that he had neither given any property to accused No.1 nor had he married her, though he had promised to marry her. The deceased allegedly abused accused No.1 and refused to give any property to her. Accused No.1 and 2 therefore manhandled Venkatesh and pushed him to the road. It appears that Venkatesh sustained grievous injuries on his head when he fell down to the road. Accused No.1 and 2 thereafter allegedly assaulted him with their hands and legs and went away. Venkatesh, aged about 64 years, who had sustained injuries in the incident, subsequently succumbed to the same. - 4 -

5. Undisputedly, accused No.1 and 2 have not used any weapon to assault the deceased. After they quarreled with the deceased for the reason aforesaid, they had pushed him and when he fell down on the road, he had suffered injuries on his head.
The allegation as against accused No.1 and 2 is that thereafter, they assaulted him with their hands and legs. Accused No.1 has been granted regular bail in the present case by the coordinate Bench of this Court in Crl.P.No.1805/2026
disposed of on 24.03.2026. The petitioner, who is her uncle has no other criminal antecedents and he is in judicial custody from 17.11.2025. The petitioner is stated to be a married man having family.
6. Considering the aforementioned aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following:
