SL. 8 31.03.2026 Court No.19 BP WPA 6905 of 2026 Samiul Khan -versus- The State of West Bengal & Ors. Mr. Tarun Kumar Das Mr. Pratap Kumar Yadav ..for the petitioner Mr. Sourav Chaudhuri Mr. Ezaz Hossain ..for the State Affidavit of service filed in Court today is taken on record. The petitioner claims that the respondent authorities have not yet issued the land loser certificate in spite of the fact that the land of the petitioner was acquired under various land acquisition proceedings. The learned advocate appearing for the State raises an objection as to the maintainability of the writ petition on the ground of inordinate delay and laches. The petitioner has specifically stated that certain plots of land was acquired vide L.A. Case No. 117 of 1973- 74. The petitioner has further stated that certain lands have also been acquired vide L.A. Case No. 5 of 1999-2000 for installation of Super Thermal Power at Kolaghat, Purba Medinipur. Record reveals that the land loser certificate has been issued in favour of Rabeya Khatoon that is the 2 grandmother of the present petitioner in connection with the acquisition proceedings of 1973-74. No acceptable reasons have been assigned by the petitioner in this writ petition as to why the petitioner approached the authorities for issuance of a land loser certificate only on 24th February, 2026 in connection with an acquisition proceedings of the year 1999-2000. Though there is no period of limitation for filing an application under Article 226 of the Constitution of India but it is now judicially settled that a writ petition may not be entertained if the petitioner is guilty of inordinate delay and laches. In the absence of any acceptable reasons for the inordinate delay in approaching the authorities, this Court is not inclined to grant any relief to the petitioner. Accordingly, WPA 6905 of 2026 stands dismissed. There shall be however no order as to costs.
