JUSTICE V.SRISHANANDA) Heard Sri Ullas U. Doddamani, learned counsel for the petitioners and Sri P.N.Hatti, learned High Court Government Pleader. 2. Accused Nos.2, 6 and 7 in Crime No.142/2025 registered by the Gokul Road Police, Hubballi North Sub Division, Hubballi Dharwad City are the petitioners seeking for grant of bail. They have been charge sheeted for the offences punishable under Sections 115(2), 118(1), 352, 329(4), 308(2), 140(3), 310(2) r/w 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 27(1) of the Arms Act. 3. Attempt made by the petitioners before the Trial Court to obtain an order for grant of bail is turned down. Charge sheet material would go to show that a rod has been used in the assault and therefore, provisions of Arms Act have been invoked. - 3 - HC-KAR NC: 2026:KHC-D:2553 CRL.P No. 100007 of 2026 4. However, assault made with the help of jack rod has not resulted in grievous injuries and wound certificate issued by the doctor indicates simple injuries and no fractures are noted. 5. Taking note of the fact that charge sheet has been filed, continuation of the petitioners/accused in judicial custody is no longer warranted. 6. Other apprehensions expressed by the prosecution can be met with by imposing suitable and stringent conditions. 7. Accordingly, the following: ORDER (i) Petition is allowed. (ii) Petitioners/accused Nos.2, 6 and 7 in Crime No.142/2025 registered by Gokul Road Police, Hubballi North Sub Division, Hubballi Dharwad City, are enlarged on bail on executing personal bonds in a sum of Rs.50,000/- each with two sureties for the likesum to the satisfaction of the Trial Court. (iii) Petitioners/accused Nos.2, 6 and 7 shall not threaten the prosecution witnesses in any manner. - 4 - HC-KAR NC: 2026:KHC-D:2553 CRL.P No. 100007 of 2026 (iv) Petitioners/accused Nos.2, 6 and 7 shall mark the attendance in the police station every Sunday between 10.00 am and 2.00 pm till final report is filed. (v) Petitioners/accused Nos.2, 6 and 7 shall not leave the jurisdiction of Dharwad without prior permission of the Court. (vi) Petitioners/accused Nos.2, 6 and 7 shall attend the Court regularly.
