ORAL ORDER
1. Accused No.1 in S.C. No.10022/2025 pending before the Court of V Additional District and Sessions Judge, Tumkuru sitting at Tiptur, arising out of Crime No.10/2025 registered by Kibbanahalli Police Station, Tumkuru for offences punishable under Sections 109, 103(1), 115(2), 118(1), 118(2), 351(3), 352, 249(b), 54 r/w Section 3(5) of BNS, 2023 is before this court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.10/2025 was registered by Kibbanhalli Police Station, Tumakuru initially for offences punishable under Section 115(2), 118(1), 109 r/w 3(5) of BNS 2023 against the petitioner and his wife based on the first information dated 11.02.2025 received from Manjunatha (CW1) who is the husband of Bhavya Y.M. (CW2) deceased in the present case. - 3 -

4. During the course of investigation, petitioner herein was arrested on 12.02.2025 and remanded to judicial custody. After completing investigation, charge sheet was filed initially for the offences punishable under Sections 115(2), 118(1), 118(2), 109, 3(5), 351(3), 352, 249(b), 54 r/w 3(5) of BNS, 2023. 5. It appears that subsequently the injured Bhavya had died in the hospital on 15.08.2025 and thereafter Additional charge sheet was filed invoking offence punishable under Section 103(1) of BNS, 2023. 6. Perusal of the charge sheet material reveals that family of the petitioner and the family of the deceased are neighbours had some dispute and on 10.02.2025 when accused No.1 was riding his motorbike, the dog of CW1 - Manjunath, allegedly ran behind his bike and therefore accused No.1 stopped his bike and abused CW1 and his wife CW2. It appears that accused No.2 who came there also joined him and thereafter she allegedly assaulted CW2 with her hands. In the meanwhile, petitioner allegedly picked up a wooden club and assaulted CW2 with the same on her head and other parts of the body and as a result, she suffered grievous injuries and was

admitted in the hospital. It is under these circumstances, FIR was registered against the petitioner and others. Subsequent to filing of charge sheet, injured- CW2 - Smt. Bhavya had died on 15.08.2025 in the hospital while undergoing treatment. 7.
During the course of trial, prosecution has examined four charge sheet witnesses as on this date as PW1 to PW4. Material charge sheet witnesses including CW1, CW3, CW4 and CW5 have been already examined. Learned counsel for the petitioner who has produced the copy of the deposition of the aforesaid witnesses has made a submission that all the witnesses have turned hostile and therefore they have been cross examined by the prosecutor but nothing has been elicited from the mouth of these witnesses. Be that as it may, fact remains that petitioner who has no other criminal antecedents is in custody from 12.02.2025 onwards. Incident in question had taken place after the parties had fought against each other on a petty issue. 8. Under the circumstances, I am of the opinion that prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following

ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in S.C. No.10022/2026 pending before the Court of V Addl District and Sessions Judge, Tumkuru (Sitting at Tiptur) arising out of Crime No.10/2025 registered by Kibbanahalli Police Station, Tumkuru for offences punishable under Sections 109, 103(1), 115(2), 118(1), 118(2), 351(3), 352, 249(b), 54 r/w Section 3(5) of BNS, 2023 of Kibbanhalli subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the date of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
