This is the 2nd attempt of the petitioner seeking bail in connection with Srinagar P.S. Case No. 46 of 2024 registered for the offence under Sections 323, 376, 504, 506 of the Indian Penal Code and under Section 3 and 4 of the POCSO Act. 3. Earlier the bail application of the petitioner was rejected on 17.09.2025 in Cr. Misc. No. 63173 of 2025 which reads as follows:- Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner seeks bail in connection with Srinagar P.S. Case No. 46 of 2024 registered for the offence under Sections 323, 376, 504, 506 of the Indian Penal Code and under Section 3 and 4 of the POCSO Act. 3. As per the prosecution case, the Patna High Court CR. MISC. No.39521 of 2026(2) dt.07-07-2026 2/2 petitioner is accused of committing rape with a minor victim. 4. The petitioner is in jail since 22.02.2025. 5. Considering the nature of allegation levelled against the petitioner, this Court is not inclined to grant bail tothe petitioner. 6. Accordingly, this application is dismissed. 4. The learned counsel for the petitioner submits that in the trial, out of eight witnesses, four witnesses have been examined. 5. Considering the fact that the trial has started and is progressing, this Court finds no ground to review its earlier order. Accordingly, this application for regular bail stands dismissed.
