JUSTICE ASHOK S.KINAGI ORAL ORDER The petitioners have filed this writ petition seeking the following reliefs: 1. Issue a writ of Certiorari or any other appropriate writ, order or direction quashing the Circular dated 08.04.2026 bearing Sankhye: KaRaakaaVi/Pariksha Vibhaga/2025-26/54 (¸ÀASÉå:PÀgÁPÁ«/¥ÀjÃPÁë «¨sÁUÀ/2025- 26/54) issued by Respondent No.2 - Registrar (Evaluation), Karnataka State Law University, Hubballi, produced as Annexure-B, insofar as it mandates repeater students to appear for 'Labour and Industrial Law-I' and 'Labour and Industrial Law-II' in place of Labour Law-I and Labour Law-II; 2. Issue a writ of Mandamus or any other appropriate writ, order or direction directing respondent No.1- Karnataka State Law University, represented by its Vice-Chancellor, and respondent No.2-Registrar (Evaluation), Karnataka State Law University, Hubballi, to conduct examinations in Labour Law-I and Labour Law-II for students admitted under the earlier syllabus who have failed in and/or are repeaters in the said subjects; 3. Grant such other order or relief as this Hon’ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity. 2. Brief facts, leading rise to the filing of this petition are as follows: Three years LL.B. course commenced and the petitioners were admitted to the course under the syllabus containing, inter alia, Labour Law-I and Labour Law-II. Respondent No.2 introducing the revised syllabus and directing repeater students to appear for Labour and Industrial Law-I and Labour & Industrial Law-II in place of Labour Law-I and Labour Law-II, thereby giving rise to the cause of action for the present Writ Petition. 3. Heard Sri S.Sreevatsa, learned Senior counsel for the petitioners, and also Smt. Saritha Kulkarni, learned counsel for respondent Nos.1 and 2. 4. Learned Senior counsel for the petitioners submits that the issue involved in this case is squarely - 5 - HC-KAR NC: 2026:KHC:29670 WP No. 17879 of 2026 covered by the order of the Co-ordinate Bench of this Court in the case of SACHIN.R AND ANOTHER VS. THE KARNATAKA STATE LAW UNIVERSITY AND OTHERS in W.P.NO.34457/2024 disposed of on 17.12.2024. It is submitted that the present writ petition be disposed of in terms of the said order. 5. Learned counsel for the respondent-University submits that the writ petition be disposed of in terms of the order passed by the Co-ordinate Bench of this Court in the case of SACHIN.R (Supra). 6. Perused the records and considered the submissions of the learned counsel for the parties. 7. It is an undisputed fact that the petitioners were admitted for 3 years LL.B. course under the syllabus containing, inter alia, Labour Law-I and Labour Law-II. Respondent No.2 issued a circular dated 08.04.2026 introducing the revised syllabus and directing the repeater - 6 - HC-KAR NC: 2026:KHC:29670 WP No. 17879 of 2026 students to appear for Labour and Industrial Law-I and Labour and Industrial Law-II in the place of Labour Law-I and Labour Law-II. 8. Insofar as students who have already attended classes of Labour Law-I and Labour Law-II, they have failed in the examination conducted for Labour Law-I and Labour Law-II. Now respondent No.2, by virtue of circular dated 08.04.2026, insisting the petitioners to appear for the Labour and Industrial Law-I and Labour and Industrial Law-II. Admittedly, the college has not brought the subjects i.e., Labour and Industrial Law-I and Labour and Industrial Law-II. The respondent University cannot direct the students to appear for the subject, which were not taught to them. As the college has taught the petitioners subjects Labour Law-I and Labour Law-II, the action of the respondents in directing the petitioners to appear for the Labour and Industrial Law-I and Labour and Industrial Law-II is arbitrary. - 7 - HC-KAR NC: 2026:KHC:29670 WP No. 17879 of 2026 9. In view of the above discussion, I proceed to pass the following: ORDER i. The writ petition is allowed. ii. The circular dated 08.04.2026 issued by respondent No.2 vide Annexure-B insofar as the petitioners are hereby quashed. iii. Insofar as the petitioners are concerned, who have already taken up the course on the Labour and Industrial Law-I and Labour and Industrial-II, the respondents are directed to conduct examination for the petitioners, who have appeared for Labour Law-I and Labour Law-II and not to insist on the examination to be conducted with regard to the Labour and Industrial Law-I and Labour and Industrial Law-II. iv. The respondents are directed to accept the examination fee and permit the students to appear for the ensuing examination in the subject i.e., Labour Law-I and Labour Law-II as repeater. - 8 - HC-KAR NC: 2026:KHC:29670 WP No. 17879 of 2026 v.
